Registering a Death Abroad with the UK from Spain

You Don't Have to Register — But You Might Want To

There is no legal requirement to register the death of a British national with UK authorities when the death occurred in Spain. The legalised Spanish death certificate (Certificado Literal de Defunción, apostilled and sworn-translated) is sufficient for UK probate, banking, and tax purposes; individual pension providers may set their own document requirements.

But some UK institutions are more comfortable with a British death certificate. If you're dealing with multiple banks, pension providers, and insurers, a UK-format death certificate from the General Register Office can simplify repeated submissions.

The Consular Death Registration Process

To create a permanent UK-style record of the death, apply through the FCDO's Overseas Registration Unit in London. You'll need:

• The original Spanish civil registry death certificate (literal copy)
• The deceased's original British passport or full birth certificate (proving British nationality)
• £150 registration fee, plus £50 per certified copy ordered
• Secure courier charges for return of original documents

Processing takes approximately eight weeks from receipt. The resulting certificate looks and functions like any UK death certificate, but it's issued by the FCDO rather than a local registrar.

You don't need to travel to Spain or visit a British consulate to complete this. The application is handled entirely by post and online through the Overseas Registration Unit.

Check Whether Tell Us Once Applies

The UK's "Tell Us Once" service — which notifies multiple government departments about a death in a single phone call — is not automatically available just because the death occurred abroad. If the deceased normally lived in England, Scotland or Wales and was abroad temporarily, a register office may enable Tell Us Once after verifying the foreign death certificate. If the deceased normally lived in Spain, you must contact UK departments separately.

If Tell Us Once is unavailable, contact the relevant UK government departments separately:

DWP Bereavement Service Call 0800 731 0469 (free from the UK) or +44 191 218 1914 (from abroad) to stop state pension payments. Any pension payments received after the date of death are overpayments that must be repaid. Have the deceased's National Insurance number ready.

HMRC Notify them to close the deceased's tax record, stop any tax credit claims, and resolve Self Assessment obligations for the tax year of death.

Private Pension Providers Contact each provider directly with a certified English translation of the Spanish death certificate to update records and initiate death benefit claims.

UK Banks and Building Societies Each institution needs its own original or certified copy of the legalised death certificate. Some accept the apostilled Spanish version directly; others ask for the FCDO-registered UK certificate. Ask which they require before sending documents.

Life Insurance Companies Submit the legalised death certificate along with the policy documents. If the death was subject to judicial investigation in Spain, the insurer may also want the medical report or autopsy findings.

The Bereavement Support Payment

If the deceased's spouse or civil partner is under State Pension age and the deceased paid sufficient National Insurance contributions, they may qualify for the Bereavement Support Payment. This is a lump sum of £2,500 or £3,500 (depending on eligibility, including whether the claimant was getting or entitled to Child Benefit for a child living with them, or was pregnant), followed by up to 18 monthly payments.

To receive the one-off payment and all 18 monthly payments, claim within 3 months of the date of death. Claims made later but within 12 months may receive the one-off payment and fewer monthly payments; claims made after 12 months but before 21 months may receive some monthly payments but no one-off payment. After 21 months, you usually cannot receive any payments. Contact the DWP Bereavement Service on the number above to start the claim.

Funeral Expenses Payment

UK residents on qualifying benefits (Universal Credit, Pension Credit, Income Support, or income-based ESA/JSA) can apply for a Funeral Expenses Payment from the Social Fund. This is means-tested and covers basic costs. It can be used toward funeral expenses incurred abroad, though the amount rarely covers the full cost of a Spanish funeral or repatriation.
