Rights of the Family When an Indonesian Citizen Dies Abroad

Consular Assistance Is a Right, Not a Favor

The Indonesian Embassy (KBRI) and Consulate General (KJRI) offices are the official channels for consular assistance to Indonesian citizens abroad, including in death cases. The consular mission can help with:

• Issue a consular death statement (Surat Keterangan Kematian) free of charge
• Cancel the deceased's passport and manage the official record
• Issue an SPLP (temporary travel document) if the passport is missing or expired
• Coordinate with Malaysian authorities on the family's behalf
• Provide general procedural guidance and point the family toward relevant funeral or translation services where available

What the embassy does not do: pay for repatriation, cover hospital bills, hire lawyers for estate disputes, or intervene in Malaysian criminal investigations. The consular budget doesn't extend to private costs. Families of undocumented workers especially need to understand this boundary — the embassy will handle documentation and identity verification, but the financial burden of repatriation falls on the family or community fundraising.

Employer Obligations for Migrant Workers

If the deceased was a documented migrant worker (Pekerja Migran Indonesia), their Malaysian employer has specific legal obligations:

• Immediate notification to the relevant authorities and the deceased's family
• Cooperation with insurance claims — if employer-sponsored coverage exists, the employer should help initiate the claim
• Workplace death investigation — for deaths caused by industrial accidents, the employer must cooperate with the relevant workplace-safety authorities

Ask the employer for an accounting of any unpaid wages, overtime, leave entitlements, or other contractual amounts as part of the estate administration.

BPJS Ketenagakerjaan Benefits

Registered migrant workers' families are entitled to specific social security benefits through BPJS Ketenagakerjaan:

• Jaminan Kematian (JKM): IDR 42 million for non-work-related deaths — comprising IDR 20 million death allowance, IDR 12 million periodic pension, and IDR 10 million burial costs
• Jaminan Kecelakaan Kerja (JKK): IDR 85 million for workplace accident deaths
• Educational scholarships: For workers with at least three years of active contributions, up to two children can receive scholarships ranging from IDR 1.5 million (primary school) to IDR 12 million (university) annually, capped at IDR 174 million per child

These benefits are filed through the e-Klaim PMI portal or at a regional BPJS office in Indonesia. The family needs the active membership card, legalized death certificates, an heirship certificate (Surat Keterangan Ahli Waris), and their own identity documents.

Estate and Financial Rights

The family has the right to access the deceased's assets in both Malaysia and Indonesia, though the process differs by jurisdiction:

In Malaysia: Banks freeze accounts upon notice of death. Accessing them requires either a Grant of Probate (if there's a will) or a Letter of Administration (without a will) from the Malaysian High Court. In Indonesia: Banks require the Disdukcapil death reporting certificate, a certified heirship certificate, and the updated Kartu Keluarga before releasing funds. Without these, access may remain delayed while the records are updated.

The family can ask the estate administrator for a clear accounting of debts. Questions about creditors and distribution should be handled through the Malaysian probate or estate-administration process.

What You're Not Told

Families are rarely informed that hospitals may require outstanding medical bills to be settled or otherwise resolved before releasing remains. If the deceased had travel or health insurance, the insurer can authorize direct payment to the hospital, releasing the remains without the family paying out of pocket.
