Sikh Estate Settlement and Bereavement Benefits in the UK

The Administrative Aftermath

Once the funeral is over and the Bhog ceremony complete, the financial and legal administration begins. This part of bereavement is faith-neutral — the same processes apply to every family in England and Wales — but British Sikh families sometimes face specific complications around overseas assets, joint family property in India, and the intersection of UK probate with Indian succession law.

Tell Us Once: The First Administrative Step

The Tell Us Once service notifies multiple government departments of the death in a single call. The registrar gives you the reference number when you register the death. Call 0800 085 7308 (England and Wales) or use the online portal within 28 days of registration.

One notification covers: DWP (pensions, benefits), HMRC (tax), local council (council tax, electoral register, housing benefit), passport office, DVLA, and the Veterans Agency if applicable.

This saves you from making 7–10 separate phone calls. Do it within a day or two of registration while you have the death certificate and National Insurance number to hand.

Bereavement Benefits

Bereavement Support Payment (BSP). The standard rate is a £2,500 lump sum plus 18 monthly payments of £100. A higher rate — £3,500 plus 18 monthly payments of £350 — applies in specified circumstances, including when the surviving partner was pregnant or getting or entitled to Child Benefit for a child living with them. You usually need to claim within 21 months of the death; claim within 3 months to receive the full amount.

Living together as though married can also qualify, subject to the other eligibility rules. This matters for British Sikh families where the relationship was recognised by the community and Gurdwara (Anand Karaj) but not registered with the UK authorities.

Funeral Expenses Payment. If you're on a qualifying benefit, you may be able to claim help with burial or cremation fees, travel to arrange or attend the funeral, moving the body within the UK, death certificates or other documents, and up to £1,000 for other funeral expenses. The payment can be deducted from money received from the deceased's estate. If the deceased had a prepaid funeral plan, support for items not covered by the plan is limited to £120.

War Disablement Pension — Bereavement. If the deceased was a veteran receiving a War Disablement Pension, ask Veterans UK whether any survivor or bereavement payment applies to your circumstances.

Probate and Estate Administration

If the deceased owned property, shares, savings, or other assets, ask each bank or institution whether a Grant of Probate (if there's a will) or Letters of Administration (if there's no will) is required. There is no universal bank threshold.

With a will: The executor named in the will applies for probate through the HM Courts & Tribunals Service. The application can be done online. Processing times vary, so check the current HMCTS estimate.

Without a will (intestacy): UK intestacy rules determine who inherits. The surviving spouse receives the first £322,000 plus personal possessions, and the remainder is split between the spouse and children. If there's no spouse, children inherit everything equally.

Inheritance Tax (IHT). The nil-rate band is £325,000 per person. A residence nil-rate band of up to £175,000 may also apply when a qualifying home passes to direct descendants, subject to the rules and taper. Do not assume an estate below £500,000 is exempt: the available allowances depend on the assets and beneficiaries. The surviving spouse exemption means assets left to a spouse or civil partner usually pass tax-free.

Overseas Assets: Property and Accounts in India

Many first-generation British Sikhs own property in Punjab — agricultural land, a family home, or a flat in Chandigarh or Jalandhar. UK probate does not by itself transfer Indian property. Indian succession, property, and registration rules apply, so obtain advice from a lawyer qualified in the relevant Indian jurisdiction.

Key complications:

  • Power of attorney. If you need to manage Indian property from the UK, ask the relevant Indian mission and the local property lawyer which form of Power of Attorney and authentication they currently accept. Costs and procedures vary.
  • Repatriation of funds. Selling Indian property and bringing the proceeds to the UK triggers both Indian capital gains tax and potential UK tax reporting obligations. An accountant experienced with cross-border estates is worth the fee.
  • Joint family property. In Sikh Punjabi families, property is often held informally as joint family property without clear individual title deeds. Sorting out ownership may require a local lawyer in Punjab.

Bank Accounts and Financial Administration

Contact each bank with a copy of the death certificate (the registrar provides multiple copies — order 4–6, because every institution wants an original or certified copy).

  • Joint accounts typically transfer to the surviving holder automatically.
  • Sole accounts may be restricted until the bank's requirements are met, which may include a grant of representation. Ask each bank what it needs.
  • Life insurance claims are separate from probate. Contact the insurer directly with the policy number and death certificate, and ask about its current claims process and timescale.

Pension Claims

  • State Pension. If the deceased was receiving the State Pension, DWP is notified through Tell Us Once. Any overpayment (pension paid after the date of death) must be returned.
  • Workplace pensions. Contact the deceased's employer or pension provider. Death-in-service benefits and pension lump sums may be paid outside the estate to a nominated beneficiary, depending on the scheme and nomination, so ask the provider how they are treated.
  • Indian pensions or provident fund. If the deceased worked in India and contributed to the Employees' Provident Fund (EPF), the nominee can claim the balance. Contact the regional EPF office with the death certificate and nominee identification.
