Social Security Survivor Benefits After a Death Abroad in the Dominican Republic

When an American citizen dies in the Dominican Republic, their surviving spouse and eligible dependents may be entitled to Social Security survivor benefits. The Social Security Fairness Act, signed on January 5, 2025, repealed the offsets retroactively for benefits payable from January 2024 onward.

Here's what surviving family members need to do, starting with the death notification.

Notify Social Security Promptly

Someone needs to formally report the death to the Social Security Administration (SSA) to stop any ongoing benefit payments to the deceased and prevent overpayment claw-backs. The U.S. Embassy in Santo Domingo generates an eCRODA (electronic Consular Report of Death Abroad) that can be used as proof of death for SSA claims, but do not wait for the embassy process to notify SSA directly.

Call SSA directly at 1-800-772-1213 to report the death. You'll need the deceased's Social Security number, date of birth, and date of death. This call records the death with SSA and starts the survivor-claim process.

The GPO and WEP Are Repealed — Check Your Benefits

The Social Security Fairness Act (H.R. 82), signed January 5, 2025, eliminated two provisions that had reduced or wiped out benefits for people who also received a government pension from non-covered employment (jobs where Social Security payroll taxes weren't withheld, like public school teaching or state police work):

• Government Pension Offset (GPO) — previously reduced spousal and survivor benefits by two-thirds of the recipient's government pension, often reducing them to zero
• Windfall Elimination Provision (WEP) — previously reduced retirement and disability benefits for workers with non-covered pensions

The repeal is retroactive to January 2024. SSA has adjusted benefits and distributed over $17 billion in retroactive payments to approximately 3.1 million affected beneficiaries.

Two Action Paths

If the survivor was already receiving a reduced benefit: SSA has automatically adjusted the ongoing monthly payment to the full unreduced amount. Audit bank statements for a retroactive lump-sum payment covering the withheld amounts back to January 2024. If the adjustment hasn't appeared, call 1-800-772-1213 immediately.

If the survivor never applied because of the offsets: Many eligible people never filed because the GPO or WEP would have made the benefit worthless. SSA does not automatically enroll these individuals — you must file a new application.

Survivor benefit applications cannot be submitted online. You must either:

• Call 1-800-772-1213 (Monday–Friday, 8:00 AM–7:00 PM) to schedule an interview
• Visit a local Social Security office in person

Bring the eCRODA as proof of death, along with your own identification and any marriage or birth certificates establishing your relationship to the deceased.

State Pension Offsets Still Exist

The federal GPO and WEP are gone, but some state-level pension plans still maintain their own internal offset rules — plan-specific provisions that adjust the state pension payout if a member becomes eligible for Social Security. These are governed by state law and are completely unaffected by the federal repeal.

If the deceased or the surviving spouse receives a state or municipal pension, contact the specific retirement system administrator to confirm whether any plan-level offsets apply.
