  • The deceased's Social Security number (on W-2 forms, old tax returns, or SSA correspondence)

Category 3: Financial Account Documents

Bank and Brokerage Account Records

  • Account statements showing account numbers, current balances, and ownership
  • Required to: determine whether the small estate affidavit pathway is appropriate (personal property under $100,000) and to close or transfer accounts

Life Insurance Policies

  • Locate all policies (personal, employer-provided group life, and AD&D)
  • Each insurer will require: the original policy or policy number, a completed claim form, and a certified death certificate
  • Check the deceased's employer's HR department for group coverage not tracked separately

Retirement Account Statements

  • IRA, 401(k), 403(b), or other accounts with named beneficiaries
  • Contact each custodian — these typically transfer directly to named beneficiaries without probate

Most Recent Tax Returns (last 2 years)

Small Estate Affidavit for Personal Property (SDCL 29A-3-1201)

  • Used when: total estate under $100,000, no DSS Medicaid debt, and at least 30 days have passed since death
  • Filed with: banks, brokerage firms, and other asset-holding institutions
  • Must be: notarized (signed in front of a notary public with seal)

Affidavit for Succession to Real Property (SDCL 29A-3-1203)

  • Used when: South Dakota real estate value under $50,000, at least 60 days have passed
  • Filed with: county Register of Deeds in the county where the property is located
  • Required documentation: certified death certificate accompanies the affidavit

Form MV215 — Affidavit of Vehicle Ownership by Succession

Form MV-609 — Motor Vehicle Excise Tax Exemption

  • Filed with: county treasurer simultaneously with MV215
