Your Right to a Welsh-Language LPA

The Welsh Language (Wales) Measure 2011 places a binding legal duty on public bodies operating in Wales to treat Welsh and English on a basis of complete equality. That includes the Office of the Public Guardian, HM Courts and Tribunals Service, and every local Register Office in Wales. All official LPA forms — LP1F (Property and Financial Affairs), LP1H (Health and Welfare), and the fee exemption form LPA120 — are available as fully bilingual Cymraeg/English documents.

You are entitled to submit your application in Welsh, receive correspondence in Welsh, and use the OPG's dedicated Welsh-language helpline for support. This is not a courtesy; it is a statutory obligation.

The Digital Gap — and How to Work Around It

In practice, the OPG's online "Make an LPA" portal has limitations for Welsh-language applicants. The digital drafting tool operates in English. Donors who want a fully bilingual or Welsh-only application currently need to draft online in English, print the completed forms, and then submit them as a paper application through the post.

Paper applications take longer to process — typically 12 to 16 weeks compared to 8 to 12 weeks for fully digital submissions. The OPG has acknowledged this structural bottleneck. The Powers of Attorney Act 2023 includes provisions for digital modernisation that should eventually address it, but as of 2026, the paper route remains the practical path for Welsh-language submissions.

For the fee: the £92 registration cost per LPA applies identically regardless of language. The LPA120 fee exemption form is also bilingual, and qualifying applicants (those receiving Pension Credit Guarantee Credit, Income Support, or Income-based JSA) pay nothing. Universal Credit recipients with gross annual income under £12,000 receive a 50% reduction to £46.

The OPG Welsh Language Scheme

The OPG maintains a formal Welsh Language Scheme covering all customer-facing services. This means:

• Correspondence in your chosen language — if you write to the OPG in Welsh, they respond in Welsh
• Phone support via a dedicated Welsh-language helpline
• Guidance documents and information sheets available bilingually
• No delay or prejudice — Welsh-language applications must not be treated as lower priority or routed to a slower queue

If you experience delays or service failures related to language, you can raise a complaint through the Welsh Language Commissioner's office. The Commissioner has published casework demonstrating that internal linguistic capacity within Whitehall policy teams has caused processing bottlenecks for Welsh-language applicants — it is a known structural issue, not a reason to switch to English.

Bilingual Considerations for Attorneys and Witnesses

The content of an LPA — the donor's preferences, instructions, and restrictions — can be written in Welsh. However, if any party in the signing process (a certificate provider, witness, or person to notify) does not read Welsh, practical clarity matters. Consider including an English translation of detailed instructions alongside the Welsh text, or noting in the preferences section that the Welsh text is authoritative.

For Health and Welfare LPAs, the medical professionals who will eventually rely on the document need to understand its instructions. NHS Wales clinicians in Welsh-speaking areas will be familiar with bilingual documentation, but if the donor may receive care in England or from locum staff, a bilingual format ensures the instructions are followed regardless of who reads them.

Getting It Right the First Time

An OPG rejection sends the entire application back to the start of the processing queue. For Welsh-language paper applications, that means another 12 to 16 weeks — a delay that can be devastating if the donor's capacity is declining. Getting the signing order, witness requirements, and certificate provider arrangements correct on the first attempt is essential.
