Indian Banks Will Reject Your US Death Certificate Without an Apostille
India joined the 1961 Hague Apostille Convention. A US death certificate used for legal or financial matters in India — including bank claims, court proceedings, or property transfers — must be authenticated with an apostille. A plain certified death certificate, even one with the state seal, is not sufficient for those uses.
The apostille must come from the Secretary of State in the specific US state where the death occurred. A California death requires a California apostille. A New York death requires a New York apostille. There is no federal apostille, and US Embassies in India cannot issue one.
The Process in Three Steps
Step 1: Obtain a certified copy of the death certificate from the County Clerk, County Recorder, or State Registrar of Vital Records. Photocopies cannot be apostilled.
Step 2: Submit the certified copy to the Secretary of State's office in that state for apostille authentication.
Step 3: Receive the apostilled document. It is now valid for legal use in India without further authentication.
The entire apostille process must be completed within the United States before the document is sent to India. You cannot get this done at the other end.
State-Specific Procedures
California
California death certificates must be certified copies issued by the County Clerk, County Recorder, or State Registrar. If the certificate is signed by a local county health officer rather than the registrar, it needs an additional county-clerk legalization step before the Secretary of State will accept it.
- In-person apostille: 1–3 business days at the Sacramento or Los Angeles offices
- By mail: 5–10 business days
- Cost: $21–$28 per certified copy (varies by county) plus the apostille fee
- Private expediting services can handle the Sacramento Secretary of State apostille in 1–2 business days
New York
New York has the most complex process in the country. Deaths within the five boroughs of New York City go through NYC Vital Records, which operates a separate registry system from New York State.
For NYC deaths, you must request a Letter of Exemplification when ordering the death certificate. This document then goes to the New York County Clerk for manual certification before the New York State Department of State will issue the apostille.
- Timeline by mail: 3–4 weeks end to end (NYC delays are common)
- Walk-in service: Limited to 10 documents per visit at offices in Albany, NYC, and regional locations
- Cost: $15 per copy (NYC) or $30 per copy (NYS) plus the apostille fee
If the deceased died in upstate New York (outside the five boroughs), the process is more straightforward — the state-issued certificate goes directly to the Department of State without the exemplification step.
New Jersey
New Jersey uses a mandatory Electronic Death Registration System with strict identification rules for next-of-kin applicants.
- Timeline: 5–7 business days for the certificate; apostille through the Division of Revenue in Trenton
- Cost: $25 for the first certified copy, $2 for each additional
- Relatively fast: One of the simpler state processes
Texas, Illinois, and Other States
Other states have their own procedures for certifying a death record and issuing the apostille. Check the issuing state's Secretary of State for the required county or state certification step and current processing time.

How Many Apostilled Copies Do You Need
Order more copies than you think. Each Indian institution — each bank branch, each mutual fund registrar, each district court — may require an original apostilled certificate. Photocopies of an apostilled document are not accepted.
The number of apostilled originals depends on how many Indian banks, registrars, and courts require them. If the deceased held accounts at multiple Indian banks plus real estate, you may need several.
Common Mistakes
Ordering short-form certificates: Indian banks specifically require the long-form (full) death certificate showing the cause of death. Short-form abstracts are consistently rejected.
Trying to apostille from India: The apostille can only be obtained from within the United States. Have your US-based representative handle this before mailing documents to India.
Assuming the consular death registration replaces the apostille: The Indian consulate's death registration certificate and the apostilled US death certificate serve different purposes. You need both — the consular registration for passport cancellation and NOC, the apostilled US certificate for Indian financial institutions and courts.
