How to Apostille a Death Certificate in the US
Why an Apostille Matters for International Use
A US death certificate is a state-level document. Without additional authentication, Australian courts, banks, superannuation funds, and registries of Births, Deaths and Marriages have no legal obligation to accept it. The Hague Apostille — a numbered, registered stamp or certificate attached to the document — verifies the registrar's signature and seal, making the certificate legally valid in any country that is party to the 1961 Hague Convention.
Both Australia and the United States are Hague Convention members, so the apostille replaces the older, multi-step consular legalisation process. But getting one right requires knowing exactly which office handles it, because the rules vary significantly from state to state.
The Most Common Mistake
Remote executors frequently try to apostille the death certificate through the Australian Embassy, the US Department of State in Washington, or the Secretary of State in their own state of residence. None of these will work.
A US death certificate can only be apostilled by the Secretary of State in the specific state where the death was registered. A death in California requires a California apostille. A death in New York requires a New York apostille. No exceptions.
The General Process
- Order the right certificate. Request a certified, long-form death certificate from the county or state vital records office. Short-form or informational copies are ineligible for apostille in most states.
- Check the signatory. The certificate must be signed by an official whose signature the Secretary of State can verify — typically the State Registrar, County Clerk, or County Recorder. Certificates signed by a local health officer may require an additional county-level verification step first.
- Submit to the Secretary of State. Mail or walk in with the certified certificate, a completed application form, and the state-specific fee. The office attaches the apostille directly to the document.

State-Specific Workflows
New York
New York has the most complex workflow, with a strict distinction between the five boroughs and the rest of the state.
For deaths in Manhattan, Brooklyn, the Bronx, Queens, or Staten Island, order through the NYC Department of Health and Mental Hygiene. Select "Apostille/Authentication" as the reason — this triggers the issuance of a hand-signed "White Letter of Exemplification" that must accompany the certificate. Without this letter, the document will be rejected at the next step.
Take the certificate and exemplification letter to the Manhattan County Clerk for signature verification (USD 3 fee), then submit the verified package to the New York State Department of State in Albany or the NYC office on William Street. State fee: USD 10. Mail-in takes 2 to 3 weeks; same-day walk-in is available at the William Street office.
California
Order an "Authorized Certified Copy" (unrestricted) from the County Recorder, County Clerk, or State Registrar. Informational copies with restrictive disclaimers are ineligible.
If the certificate is signed by the County Recorder or State Registrar, it goes directly to the Secretary of State. If signed by a local health officer, you first need a signature verification from the County Clerk (fees vary by county — USD 7 in Ventura, USD 14 in Santa Barbara).
Submit to the California Secretary of State's Notary Public Section in Sacramento. Fee: USD 20 by mail, USD 26 with same-day walk-in handling. Mail-in processing takes 10 to 15 business days.
Texas
Texas death records are confidential for 25 years, restricted to immediate family members. Order through the local county clerk or the Texas DSHS Vital Statistics Section.
One critical rule: certificates issued by local registrars must have been issued within the past three years to qualify for a state apostille. Older certificates will be rejected — you will need to purchase a newly issued copy.
Submit to the Texas Secretary of State in Austin. Fee: USD 15. Processing takes 5 to 7 business days.
Florida
Order a certified copy "With Cause of Death" from the Bureau of Vital Statistics in Jacksonville. The certificate must bear the State Registrar's signature.
