Louisiana Power of Attorney Requirements: Forms, Rules, and How to Get One

Louisiana does not recognize the term "power of attorney" in its Civil Code. The legal instrument that grants someone authority to act on your behalf is called a mandate (or procuration), governed by Louisiana Civil Code Articles 2989 through 3032. The person granting authority is the principal, and the person receiving it is the mandatary — not an "agent" or "attorney-in-fact."

This distinction matters because banks, hospitals, title companies, and parish clerks in Louisiana routinely reject documents that use common-law terminology. A form downloaded from a national website that says "Power of Attorney" and names an "Agent" can be refused on sight.

What Louisiana Requires for a Valid Mandate

Louisiana has no standardized state-issued POA form. There is no fill-in-the-blank template approved by the legislature. Every mandate is a custom-drafted contract, and its validity depends on meeting specific execution requirements under the Civil Code.

For financial and property mandates, the instrument must be executed as an authentic act under Civil Code Article 1833. That means:

  • The principal, a licensed Louisiana notary public, and two competent witnesses must all be physically present in the same room at the same time
  • All parties must sign the document during that single, unbroken ceremony
  • If anyone leaves the room before the last signature is placed, the entire document is void
  • Names must be typed or legibly printed beneath each signature

This requirement exists because of the equal dignity rule (Civil Code Article 2993): if the transaction the mandate authorizes requires a specific legal form, the mandate itself must be executed in that same form. Since real estate transactions require authentic acts, any mandate that might touch property must also be one.

For healthcare mandates, the execution rules are slightly more relaxed. A healthcare mandate can be witnessed by two competent adults or notarized. It can be a standalone document or included in the same authentic act as the financial mandate.

Express Powers Are Not Optional

Under Civil Code Article 2996, a general mandate only authorizes acts of administration — routine account management, bill payments, basic maintenance. It does not authorize acts of disposition.

Article 2997 requires express, written authorization for each of these powers:

  • Selling, mortgaging, or leasing immovable property (real estate)
  • Making inter vivos donations (gifts)
  • Accepting or renouncing a succession (inheritance)
  • Contracting loans or endorsing negotiable instruments
  • Making healthcare and medical treatment decisions
  • Restricting communication or visitation with relatives

If the mandate does not explicitly list a power, the mandatary cannot exercise it. Banks and title companies will verify each express power before processing a transaction.

How to Get a Power of Attorney in Louisiana

The process follows a specific sequence:

  1. Choose your mandatary — must be a competent adult (18+). Name at least one successor mandatary in case the primary becomes unavailable.

  2. Decide on timing — an immediate mandate takes effect upon signing. A springing mandate (conditional procuration) activates only when a specified condition occurs, typically incapacity verified by two independent physicians. Because Louisiana law does not define "incapacity" for mandates, you must write the definition and verification procedure into the document yourself.

  3. Draft the mandate — enumerate every express power needed. Include specific language for banking (citing La. R.S. 6:311.1 for institutional acceptance), real estate, healthcare decisions, and any gifting or trust authority.

  4. Execute as an authentic act — schedule a signing with a notary and two witnesses. All parties must remain in the room for the entire ceremony.

  5. Record in parish conveyance records — if the mandate includes real estate powers, file the original or a certified copy with the Parish Clerk of Court where the property is located.

  6. Submit to financial institutions — present the executed mandate to banks before a crisis. Pre-acceptance eliminates the risk of rejection during an emergency.
