How Long Does It Take to Get Power of Attorney in Wales?

Current Processing Times (2026)

As of 2026, the Office of the Public Guardian processes LPA registrations on two tracks:

  • Digital applications (drafted online, signed and posted): 8 to 12 weeks
  • Paper applications (handwritten or printed forms posted in full): 12 to 16 weeks

These are end-to-end times from the OPG receiving a complete, correctly signed application with the £92 fee to issuing the stamped, registered document. They include the mandatory 4-week statutory waiting period built into every registration.

The digital route is faster because the OPG's online portal catches common errors during drafting — wrong signing order, missing certificate provider details, formatting problems. Paper applications arrive with those errors intact, and the caseworker has to send them back for correction, restarting the clock.

The 4-Week Statutory Waiting Period

Every LPA registration includes a non-negotiable 28-day waiting period. During these four weeks, the OPG contacts any "people to notify" that the donor named in the LPA. These are individuals the donor chose to be informed about the registration — typically close family members who are not appointed as attorneys.

Anyone notified during this period can raise an objection. Objections fall into two categories:

  • Factual grounds: the donor has died, the attorney has died, the donor and attorney have divorced (for spouse-attorneys), or the attorney is bankrupt (for financial LPAs)
  • Prescribed grounds: the LPA was obtained through fraud, the donor lacked mental capacity when signing, or the donor was under undue pressure

If no objections are received within 28 days, the application moves to final review. If an objection is raised, the OPG investigates — which can add weeks or months to the process.

What Causes Delays Beyond the Standard Timeline

The 8-to-16-week range assumes a clean application. In practice, several common problems push registration well beyond that:

Signing order errors — the LPA must be signed in a strict sequence: donor first, then certificate provider, then attorneys. If the dates suggest the order was wrong, the application is returned. This is the single most common reason for rejection.

Certificate provider problems — the certificate provider must be genuinely independent. A family member who is also named as an attorney cannot serve as certificate provider. If the OPG spots a conflict, the application is returned and a new certificate provider must be found.

Missing or incomplete LPA120 — if the donor is claiming a fee exemption or remission, the LPA120 form and evidence must be included with the application. An incomplete LPA120 can delay or derail the fee decision, so include the completed form and supporting evidence with the application.

Welsh-language paper applications — applicants submitting in Welsh use the bilingual forms and may need to use the paper route if the digital portal does not support full Welsh-language drafting. Paper-based bilingual applications are sent to the Office of the Public Guardian at PO Box 16185, Birmingham, B2 2WH, and processing times are at the longer end of the range.

There Is No Emergency Fast-Track

If a family member suffers a sudden stroke on Monday, there is no way to get an LPA registered by Friday. The 8-week minimum exists because the 4-week objection period cannot be shortened, and the OPG's casework queue adds additional weeks on either side.

This is why the universal advice from solicitors, Age Cymru, and the OPG itself is the same: register your LPA early, while the donor is healthy and there is no urgency. An LPA sitting registered and unused in a drawer is infinitely more useful than one stuck in a 12-week queue while the family cannot access bank accounts or make care decisions.

For families who have already missed this window — where a relative has lost capacity with no LPA in place — the only route is a Court of Protection deputyship application, which takes 4 to 6 months and costs significantly more.

Tracking Your Application

After submitting, you can check the status of an LPA registration by contacting the OPG directly. The OPG assigns a reference number, and caseworkers can confirm whether the application is in the waiting period, under review, or has been flagged for corrections.
